In a written statement on the matter, Ahmet Nedim Erdem stated the following:
In accordance with the Insurance Experts Assignment Regulation; As of April 1, in the provinces of Bursa and Ordu, the appraisal process for motor vehicles that have sustained severe or total damage under comprehensive insurance, as well as motor vehicles with damages of 40,000 TL or more under mandatory traffic insurance, will be conducted by insurance experts assigned in a mandatory and sequential manner through the Insurance Information and Supervision Center (SBM) systems. Insurance companies are required to assign experts through SBM for these claims. For damages under 40,000 TL under mandatory traffic insurance, if the insurance company or the claimant wishes to appoint an expert, the assignment process will again be conducted sequentially through SBM.
- Compensation for loss of value will be calculated by the claims adjuster
Under the pilot program, the claims adjuster appointed to assess damage under mandatory auto insurance will also calculate compensation for loss of value in accordance with the principle of actual loss and include the amount of such compensation in their report. If an expert is appointed for the damage assessment, the claimant will not need to make a separate request for the calculation of the loss of value compensation.
- An expert may be appointed at any stage
Provided that no expert has already been appointed in the case, an expert may be appointed at any stage by the insured, the policyholder, or any person benefiting from the insurance contract. If an expert is to be appointed for traffic insurance, the appointment will be made through SBM. Beneficiaries can easily appoint an expert by following the “Online Transactions” and “Expert Appointment” steps on the Insurance Information and Supervision Center’s website at www.sbm.org.tr and verifying their identity via e-Government.
- Parties will be able to easily object to the expert’s findings on damage and loss of value
The insurer, the insured, the policyholder, or any person benefiting from the insurance contract may object to the findings made by the expert within three business days. The objection period will begin upon notification to the parties regarding the entry of the expert’s report into the expert report system maintained by the Insurance Information and Supervision Center (SBM). In the event of an objection, an expert will be appointed through the Insurance Information and Supervision Center’s website at www.sbm.org.tr.
Upon the entry of the report prepared by the appointed expert into the expert report system at SBM, an arbitration expert may also be appointed within three business days upon the request of either party.
- The pilot program will last three months
The pilot implementation of the Smart Appointment System for Insurance Adjusters will begin on April 1, 2026, in the provinces of Bursa and Ordu and will run for a period of three months. The Insurance and Private Pension Regulation and Supervision Authority is authorized to extend this period by up to six months. If no extension is granted, the system will go into effect nationwide as of July 1, 2026.
- Expert fee to be covered by insurance companies
Effective April 1, 2026, nationwide; across all insurance lines, including auto and traffic insurance; regardless of whether the expert is appointed by the insured, the beneficiary, or the insurance company, the fee for the first expert report issued will be paid by the insurance company.
